Well. . . . .
We meet today in front of Judge Anderson in Monticello about Kiley Miller vs. Red Rock 4-Wheelers (the whole Strike Ravine thing for those who don't know).
And to make a long story short the plaintiff's motion for partial summary judgement was denied and our motion for partial summary judgement was approved. In other words WE WIN.
Basically, the judge said that since a right-of-way existed when SITLA sold the land, that the right-of-way should continue to exist even if SITLA failed to notify the purchaser of the right-of-way.
Of course they still have the right to appeal, but so far it looks very, very good for us.
Sometime in the last few months Kiley has placed several road blocks across the trail on her property, but after todays decision, Walter Bird, San Juan counties attorney said that the county will be removing the blocks very soon.
THIS DOES NOT AFFECT THE LOWER HELLDORADO TRAIL, THAT ONE WILL REMAIN CLOSED SINCE WE COULD NOT PROVE USE PRIOR TO 1992.

Yeah we made it out there, Marty showed us. The roadblocks were still up, but shouldn't be for long thanks to San Juan county.

Just wondering. Does the court ruling apply only to EJS or will the trail be open to all users? The article seemed a little vague on this. Thanks Al

It's open all the time, not just at EJS, and anybody can access the trail.

South and east of town, near the "Helldorado" and Coyote Canyon trails, if that helps. Kinda of due east of where Behind the Rocks/Pritchett Canyon trails end on Highway 191.
